Usage of the Mobile Application
MAPTED USAGE RULES
General Provisions
This document is an agreement between the service provider MB "Mapted" (hereinafter referred to as Mapted), legal entity code – 306914831, registered address – Varėna, Vytauto 22-8, email – info@mapted.com, tel. +37060529009, and the service user (hereinafter referred to as the User) regarding the use of the mobile application (hereinafter referred to as the Mobile Application). The Mobile Application can be downloaded from the "Apple App Store" and "Google Play".
By using the services of the Mapted advertisement search platform and related online resources and tools, the User agrees to the usage rules specified in this document. This document is a legal contract between the service provider Mapted and the service User. The document becomes effective upon downloading the Mobile Application and agreeing to the usage rules upon first launching the Mobile Application. If the User does not agree with the usage rules, they will not be able to use the provided services.
The User acknowledges and agrees that they are responsible for all content that they receive, send, or transmit in any other way while using the Mobile Application. In these rules, content means any information, including data, databases, symbols, text, photos, images, video materials, documents, comments, and messages that the User submits, receives, stores, sends, accepts, or transmits while using the Services and/or the Mobile Application (hereinafter referred to as the Content).
The contract entered into by the User for the placement of Content in the Mobile Application is for a fixed term, depending on the category of Content. Content placement in most categories is valid for 30 days. A longer term applies to paid advertisements. The User may terminate the contract earlier on their own initiative by deleting the Content; however, no refunds will be given for the unused Content placement time. All notifications and information between the User and Mapted will be sent electronically to the addresses specified in these rules or on the Mapted website, unless otherwise stated in these rules.
General Requirements
By using the services provided by Mapted, the User agrees to:
- Comply with all applicable laws, including the European Union General Data Protection Regulation (GDPR).
- Adhere to all Service usage rules.
- Not post offensive, threatening, obscene, or otherwise illegal content.
- Not post misleading, false, or otherwise untrue content.
- Not write misleading, false, offensive, or threatening messages in personal communications.
- Not restrict the rights of other service users or Mapted employees.
- Not create financial criminal schemes using Mapted and its communication tools.
- Not overload Mapted's IT infrastructure or disrupt the normal provision of services to other users.
- Complying with GDPR requirements, it is prohibited to publicize the personal data of other users without obtaining the consent of the individual(s).
- Complying with GDPR requirements, it is prohibited to collect and store other users' data without their consent.
- Not sell products whose sale violates the intellectual property rights, including copyrights or trademarks, of the product's creator.
The User is personally responsible for the information provided in advertisements, its truthfulness and legality, and assumes personal responsibility for the consequences if the conditions of truthfulness and legality are violated.
Mapted reserves the right, without informing the user of the reasons, to not approve advertisements that raise suspicions or in which the posted information raises suspicions.
Mapted reserves the right to temporarily or permanently block users without prior notice if they do not comply with the usage rules, disseminate information that is not true, or restrict the rights of other users.
Application of the Rules By using the mobile application, the User confirms that they have read and understood the usage rules (hereinafter referred to as the Rules) and the privacy policy (hereinafter referred to as the Privacy Policy) and fully accepts responsibility for complying with them.
Using the mobile application according to these Rules encompasses all actions (but is not limited to) that the User can perform after downloading the mobile application. These actions include: posting new advertisements, updating advertisements, viewing posted information, writing direct messages, and submitting, sending, and receiving any information and/or data (hereinafter referred to as the Services). By using the Mobile Application and/or Services, the User strictly agrees to comply with all requirements set forth in these Rules. If the User does not agree to accept and comply with all the obligations set forth in these Rules, they are not entitled to use any of the services provided by the Mobile Application.
Mapted reserves the right to change, amend, or supplement the Rules at its discretion at any time. Mapted will notify the User of any changes through the Mobile Application's notification mechanism or via email if the User has provided their email address.
Mapted reserves the right to change, modify, or discontinue the Services for any reason, including violations of the terms of this agreement, without prior notice to the User.
If any provision of these Rules contradicts the law or for any reason becomes partially or entirely invalid, this does not affect the validity of the remaining provisions of the Rules.
Improper Use
Mapted aims to ensure smooth, safe, and efficient use of the service. Users are encouraged to act responsibly and report any violations of the rules, inappropriate advertisements, and improper behavior by other users.
Mapted reserves the right to remove users and advertisements that have received complaints about violations. Mapted does not and cannot verify all information presented in advertisements, thus relying on the goodwill and responsibility of users to post or report inappropriate content.
Mapted does not assume legal responsibility for the information presented in advertisements or for any losses incurred due to inappropriate or false information on the Mobile Application. The User is solely responsible for the truthfulness and legality of the information they post and assumes responsibility for any potential consequences.
Mapted adheres to applicable national laws and European Union regulations. If necessary, Mapted cooperates with law enforcement agencies in investigations related to rule violations or illegal activities on the Mobile Application.
Services Some services provided by the mobile application are paid. Paid and free services are listed in the "Prices" section of the Mapted website. Paid services are specified at Mapted Prices .
Service users are classified into legal entities and individuals, depending on the scope of services used. An individual using free services is referred to as a "User," while an individual using paid services is referred to as a "Paid Service User." A legal entity is referred to as a "Client" (hereinafter referred to as the Client). This information is clearly indicated in the advertisement.
Free Services
The main services provided by the mobile application are free. The free services and their limitations include:
- User registration.
- Direct messaging.
- Posting a new advertisement.
- Validity of a free advertisement – 7 days.
- A free advertisement has a view limit of 500 views.
- Up to 5 photos can be uploaded with a free advertisement.
- Up to a 1-minute long video can be uploaded with a free advertisement.
Posting and Displaying Advertisements
Mapted continuously improves its services to enable users to effectively find desired goods, sell, rent, or donate their products.
To ensure the quality of services, the posting and displaying of advertisements are classified according to the following criteria:
- User's location.
- Selected set of advertisement filters.
- Geographical location of the item.
- Type of advertisement.
- For paid advertisements, priority is given to the user's posted content.
Content of Advertisements
Mapted content, protected by copyright, is created to provide maximum benefit to service users. By agreeing to Mapted's service usage rules during registration, the User commits not to copy or distribute Mapted content and to respect the copyrights of other service users. Copying and distribution can only be done with the consent of the specific content owner.
The User understands and agrees that Mapted does not control and is not responsible for the content of other Mobile Application users, visitors, or third parties, which the Client or User may encounter, receive, or otherwise become aware of while using the Mobile Application or Services. Mapted is not responsible for the accuracy, integrity, and/or quality of such content.
The User understands and agrees that Mapted has the right, at its discretion, to inspect the Content received and transmitted by the User to detect unwanted or rule-violating Content. Upon detecting such Content, Mapted has the right to remove or block it and to block users who distribute such content.
Mapted does not interfere with purchase-sale, exchange, or other transactions related to the goods and/or services offered by the User or Client of the Mobile Application.
The User agrees not to resell Mapted services without Mapted's consent. To resell Mapted services, it is necessary to contact Mapted administration via email at info@mapted.com.
When uploading an advertisement to the Mobile Application, the User is responsible for the accuracy of the information. Mapted is granted all rights to this content, allowing it to be distributed and published on Mapted partner sites and social networks.
Mapted reserves the right to modify and supplement the data in the User's advertisements to provide more detailed information to the user, and to remove inappropriate content that directly or indirectly violates the honor and dignity of an individual or group of individuals. For advertising purposes and without prior notice, Mapted may upload its own content into the user's advertisement.
PROHIBITED CONTENT
- Pornographic information or photos.
- Information or photos that incite national, ethnic, racial, religious hatred, or hatred due to non-religious beliefs.
- Content that violates the rights of third parties, including the right to image and privacy.
- Music works, films, software, and other goods that violate copyright or intellectual property rights.
- Hazardous chemicals that may pose a danger to life, health, or the environment (e.g., sulfuric acid, carbide).
- Narcotic and psychotropic substances and pure narcotic products, as well as substances used as drug substitutes, regardless of their legality in terms of possession and trade.
- Products related to tobacco, including electronic cigarettes and their refills, smoking herbal products, etc.
- Teeth whitening products containing more than 0.1% hydrogen peroxide.
- Any medicines and pharmaceutical products.
- Food supplements that are not approved by the State Food and Veterinary Service. The list of approved food supplements can be found on the State Food and Veterinary Service website .
- Human organs.
- Contains cruel and/or psychologically traumatic content.
- Shares, bonds, and securities, debt collection documents, investment fund information, insurance services and insurance policies, and all other investments or financial instruments. Prohibited Content:
- Financial instruments offered in the form of monetary contributions, except for material securities of exclusive collectible value, if the trade of such items has the necessary permit or license according to legal regulations. Otherwise, such advertisement content is contrary to the legal acts regulating financial instrument advertising.
- Software licensed as NFR (Not For Resale), trial versions, free versions, temporarily free versions, and versions with expired copyrights.
- Illegal/parasitic software and devices:
- Software containing viruses or other harmful elements.
- Software and devices that enable the collection of information about the computer user without their knowledge.
- Software and devices for locking and removing passwords from desktops, laptops, hard drives, other storage media, and car radios, as well as information, instructions, and services related to blocking and unblocking.
- Software that reads email addresses and enables mass messaging to web portal users and instant messaging/chat users.
- Software serial numbers sold separately without the original software.
- Instructions and web addresses or FTP servers where the information is provided:
- Enabling or facilitating the production or acquisition of hazardous substances.
- Secret or in violation of existing legal regulations.
- Enabling or facilitating the violation of existing legal regulations.
- Free internet portal accounts, including:
- Instant messaging and chat accounts (e.g., Gadu-Gadu, Tlen, Skype, Jabber, AQQ, ICQ).
- Free email accounts/email addresses.
- Accounts created on free internet portals and invitations to use these portal services or create accounts.
- Partnership and loyalty program accounts and services related to such programs.
- Accounts disclosing personal data information or email addresses.
- Accounts related to prepaid cards.
- Accounts about services and information related to participation in financial pyramids, i.e., financial structures created on the principle of attracting new members, where the main (or sole) source of profit is the registration fee paid by new members.
- Stock investment systems, lottery and betting systems, and services related to participation in lotteries and betting, except for officially published works with an ISBN number.
- Fishing tools and equipment regulated by legal provisions.
- Weapons and ammunition requiring a permit or registration, gas launchers, and pepper spray dispensers, regardless of the legality of possession and trade of these items, including all firearms categorized under A and B.
- Registration certificates and documents offered separately from the vehicles they pertain to.
- Mass electronic correspondence services.
- Services and information promoting sending premium-rate SMS.
- Online earning partnership systems (e.g., link viewing).
- Single-use containers filled with fluorinated greenhouse gases.
- Other goods and/or services whose trade is prohibited or restricted, requiring appropriate licenses or permits which the client does not possess, or where such licenses and permits do not grant the right to sell these goods and/or services electronically, including online trading.
- Any other goods and/or services whose trade, including online trading, is prohibited by legal regulations.
This list of "Prohibited Content" is not exhaustive. Therefore, users offering goods and/or services that potentially violate legal requirements act solely at their own risk, and Mapted is not responsible for the content of such advertisements under any circumstances.
Violations
Mapted prohibits posting content that infringes on the copyright or trademark rights of others. Additionally, posting information about counterfeit goods is forbidden.
Users must ensure the accuracy and reliability of the information. The content of the advertisement must not be offensive, degrading, or pose a threat to the safety of individuals or their property.
Most advertisements are posted by individuals. Intellectual property owners or others with rights to the goods can file complaints about the posted content. In such cases, Mapted reserves the right to remove the advertisement content from the platform's database without prior notice.
Reporting Violations:
Reports of copyright infringements or illegal use of trademarks should be sent by email to info@mapted.com. The received information is analyzed, and in case of detecting a violation, the results are communicated to all interested parties. The email must include the advertisement ID and a description of the content.
Important: Such a report can only be submitted by a user with legally justified claims regarding the content of the advertisement.
INTELLECTUAL PROPERTY RIGHTS
1. Prohibition on Alteration or Copying of Mapted Mobile Application Code:
It is prohibited to modify, alter, or copy the Mapted mobile application's source code or algorithms in any way. The Mapted mobile application is protected by copyright.
2. Ownership of Intellectual Property:
All intellectual property rights to the content of the mobile application and its database, including copyrights, industrial intellectual property rights, company names, know-how, commercial and manufacturing secrets, belong to Mapted.
3. Granting of Rights by Users and Clients:
By using the mobile application and providing, posting, or otherwise transmitting Content, the User or Client grants Mapted all copyrights necessary to implement these Terms and fulfill obligations, without compensation, for an unlimited period in an unlimited electronic space, according to the law. This includes, but is not limited to:
- The right to reproduce, modify, translate, publicly display, make publicly available, distribute by sale, lease, lend, or otherwise transfer ownership or control of the Content submitted by the User/Client.
- The right to create derivative works from the Content submitted by the User/Client.
4. User/Client Responsibilities:
Each time the User/Client submits any Content, they affirm and guarantee to Mapted that they possess all rights, permissions, consents, and/or licenses required for Mapted to perform actions with the Content as described above. This includes the right to use trademarks and copyrighted materials within the Content, publish the Content, and make it publicly available.
By agreeing to these terms, the User/Client acknowledges Mapted's ownership of intellectual property rights associated with the mobile application and its database. Furthermore, they grant Mapted the necessary rights to manage and utilize the Content they provide through the application.Atsakomybės
Mapted's Liability and User Agreement
1. Limitation of Liability:
Mapted assumes responsibility solely for errors made by its employees.
2. User Acknowledgement of Responsibility:
Users agree that Mapted is not and will not be responsible for the actions of its Users/Clients, the information provided, or any illegal activities that may pose a threat to the health, life, or property of Users/Clients.
3. Verification of User-Provided Information:
Mapted does not verify the accuracy or reliability of the information provided by Users and does not assume responsibility for its correctness or legality.
4. Transfer of Goods and Quality:
Mapted does not participate in the transfer of tangible assets between Users nor does it assume responsibility for the quality or compliance of goods with the content of the listings.
5. Illegal or Offensive Content:
Mapted disclaims responsibility for illegal or offensive content in listings that may threaten or otherwise violate the rights of others. Mapted agrees to minimize the dissemination of such content.
6. Reporting Suspicious Activities:
Mapted undertakes to report any suspicious events or content to law enforcement authorities.
7. Accuracy and Intellectual Property Rights:
Users/Clients acknowledge that Mapted does not guarantee the accuracy or precision of information. Mapted disclaims liability if the information in listings infringes upon trademark or copyright rights.
In summary, by using Mapted's services, Users/Clients agree to these terms where Mapted limits its liability to errors made by its employees and disclaims responsibility for the actions, information, or illegal activities of Users/Clients that may impact health, life, or property. Mapted also does not verify user-provided information and is not liable for its accuracy or legality.
Third Party Rights
Individuals or groups who are not parties to this agreement cannot utilize the services provided by the Mapted mobile application.
Data Protection and User Privacy
By using the services provided by the Mapted mobile application, the User/Client agrees that data about the usage of the mobile application will be collected and stored in databases within the European Union. For more details, please refer to Mapted's privacy policy.
The User/Client undertakes to comply with data protection laws, including but not limited to Regulation (EU) 2016/679 (General Data Protection Regulation "GDPR"), which includes the obligation to securely transmit data to third parties and/or organizations.
Mapted, in carrying out its activities and providing services to users, has access to confidential data such as personal information and contact details voluntarily provided by the User/Client when creating their account. This also applies to data obtained from analyzing the usage statistics of the mobile application. Mapted reserves the right to use collected data at its discretion (for example, for usage analysis of the application and sharing statistics with third parties), but commits not to disclose the identity of the User/Client.
By using the services of the mobile application, the User/Client receives information about other users and statistics on ad views. The User/Client agrees not to use this information for unlawful activities, refrain from exploiting data analysis conclusions, and not to disclose the contact information of other users to third parties.

Usage of the Mobile Application
Mapted grants the right to use the mobile application solely for personal purposes to non-legal entities. Legal entities can use the application and other Mapted services only upon separately entering into and confirming an agreement with MB "Mapted."
The User/Client is personally responsible for the safe use of the mobile application and must comply with all laws, ensuring no harm is posed to the life and property safety of other users. The User/Client assumes full responsibility for data security.
In summary, Mapted restricts the use of its mobile application to personal use for non-legal entities and requires legal entities to establish a separate agreement for access. Users are individually responsible for safe use, lawful conduct, and data security, ensuring compliance with all relevant regulations.
